OpenAI Denies Stealing Secrets


“OpenAI swung back hard at Apple's allegations it stole trade secrets, saying that the iPhone maker was sloppy about securing files after employees left and denying that the employees it hired from Apple were involved in such theft.

 

In its most detailed comments to date on the litigation, the startup said in a blog post Monday evening that Apple misrepresented the companies' discussions from before Apple filed its July lawsuit.

 

"Apple is one of the greatest companies of all time, and built a reputation for obsessing over the smallest details. This careless, aggressive and oddly personal lawsuit sadly doesn't live up to that reputation," OpenAI said in the blog post, adding that the company has a "common issue" of failing to lock up files when employees departed.

 

The post was published shortly after Apple formally asked a federal judge for a preliminary injunction to prevent OpenAI from continuing to develop devices it says are based on Apple's trade secrets. Apple also requested an expedited discovery schedule in the case and alleged in a court filing that nearly a dozen other former employees may have been involved in the purported theft.

 

Apple's lawsuit alleged three former employees who left to join OpenAI stole trade secrets, including OpenAI's chief hardware officer, Tang Tan, once a top hardware executive at Apple.

 

The lawsuit, filed in the Northern District of California, also alleged that Chang Liu, a former Apple employee who left in January to join OpenAI, kept his Apple computer and downloaded confidential files and arranged to have a former colleague share details about confidential Apple projects. That person joined OpenAI in April.

 

"OpenAI's nascent hardware business now rests on the shakiest of foundations," Apple's complaint said, accusing the AI lab of "a pattern of theft."

 

In its blog post, OpenAI included screenshots of messages showing current Apple employees continuing to ask Liu questions about Apple work after he left. In one instance, an employee seeking information about shipping a product wrote, "Of course, I could ask several folks, but you are the best. Even if you don't work here anymore."

 

OpenAI said in the blog post that it would have worked with Apple to resolve its concerns, but said the company didn't raise specific allegations at the time and didn't contact OpenAI for months after its first outreach.

 

Apple said in its filing Monday that OpenAI didn't respond to messages to its general counsel or to a letter articulating concerns about trade secrets leaking and asking to discuss remedies.

 

Apple alleged in its lawsuit that Tan probed job candidates still working for Apple for information on its projects and that OpenAI coached former Apple employees on how to evade security procedures. It also said OpenAI asked its partners and suppliers about Apple's proprietary metal-finishing technique and device components.

 

OpenAI said in the blog post that Tan has always told his team that they "do not want, and must not use" confidential information from other companies.

 

Liu and Tan didn't respond to requests for comment.

 

In its filing Monday, Apple said its investigation "has uncovered information that raises serious concerns about other former Apple employees," including one who took screenshots of confidential Apple documents before an OpenAI interview.

 

The company also said it heard from former employees now with OpenAI who reached out to discuss returning their Apple-issued work devices after the company filed its lawsuit.

 

Rather than take other companies' trade secrets, OpenAI said on its blog, "We're much more interested in building innovative products and technologies that push the frontier."

 

Last year, OpenAI acquired a startup co-founded by former Apple design guru Jony Ive, and Ive and company executives including Chief Executive Sam Altman discussed plans to produce a family of AI devices. Altman has discussed plans to ship as many as 100 million AI "companions." Its first consumer device is expected to be screenless and unobtrusive.

 

The relationship between the two companies has deteriorated since they forged an early partnership in 2024 that allowed OpenAI's ChatGPT to connect with Apple's Siri voice assistant.

 

Apple has since struck an expansive deal with Google and has used the company's Gemini model to help develop many of its new AI features, including an upgraded Siri. OpenAI considered sending a breach-of-contract notice to Apple for not promoting ChatGPT within Siri. The Wall Street Journal's parent company, News Corp, has a content deal with OpenAI. “Money is getting tighter for America's hundreds of thousands of homeowners associations, and they are extending a shorter financial leash to their residents.

 

HOAs are getting more aggressive about pursuing people who rack up unpaid dues, skipping informal grace periods to make up the payments and turning delinquent accounts over to lawyers.

 

In the most extreme cases, they are pursuing foreclosures on these properties. There were 6,376 properties with HOA-related foreclosure filings in the first quarter of this year -- spanning initial default notices to completed sales. That is up nearly 40% from two years earlier and rising faster than overall mortgage foreclosure rates, according to real-estate analytics firm Attom.

 

"HOAs are being forced into more aggressive collections to avoid their own financial collapse," said Brian Fox, co-founder of real-estate technology firm Benutech, which tracks HOA delinquency trends and foreclosures.

 

The associations that care for the common spaces in many neighborhoods and condos typically pool money from dues and special assessments to cover operating costs. When one homeowner stops paying, the rest of the owners often must collectively foot the bill.

 

Even before contending with residents' delinquencies, HOAs have been facing rising costs for staffing, lawn care and materials. Between 2024 and early 2025, master insurance policy premiums that cover shared property and general liability for HOAs rose for 91% of community associations. Some 17% saw jumps of more than 100%, according to the Foundation for Community Association Research.

 

Reserve funds essentially act as an HOA's emergency savings, but many funds that were healthy in 2020 have since been depleted by soaring repair costs for items such as roofs.

 

Tighter budgets are giving HOAs less financial wiggle room to let missed payments slide. Take, for example, Fairview Condo 1 in Middle Island, N.Y. It currently has 15 out of its 202 units behind on the $595 monthly dues, creating a monthly shortfall of roughly $8,900. That is more than the eight delinquencies that the board typically budgets for.

 

"Every delinquency has its own story," said Deborah Amilowski, president of the condo association.

 

Ten of the properties are in foreclosure. Some cases are triggered by personal financial strains such as job loss or divorce. The HOA is also foreclosing on some units owned by investors who stopped paying after their tenants didn't pay rent, Amilowski said.

 

HOA laws vary across states. Most states require formal notice periods of 30 to 45 days before HOAs can file liens or have their lawyers initiate foreclosure actions. The Community Associations Institute, which represents HOAs, said many associations offer payment plans and work directly with homeowners facing financial hardship.

 

Still, HOAs filed more than 285,000 liens last year, up about 8.8% from a year earlier, according to Benutech.

 

HOAs in many states can foreclose over unpaid dues even if the homeowner's mortgage is up-to-date. In around 20 states, HOA liens carry "super priority" status, which can give the HOA legal priority even over the primary mortgage holder, said Stephen Hladik, a North Wales, Pa., lawyer specializing in foreclosures.

 

State laws can make it difficult for communities to recover money from delinquent residents, said Glen Weinberg, founder of Fairview Commercial Lending. He said that he has seen some HOAs pushed to the brink of insolvency because of these laws, including those in his home state of Colorado. These include caps on legal fee reimbursements and strict preforeclosure requirements.

 

Legal fees tied to debt collection can add up rapidly for homeowners, creating a financial hole on top of the risk of losing their homes, consumer advocates say.

 

There are all sorts of reasons borrowers across wealth levels fall behind on their dues, from financial stress to administrative oversight.

 

In the Las Vegas suburb of Summerlin, a property linked to boxing champion Floyd Mayweather Jr. recently entered HOA foreclosure proceedings after accumulating nearly $25,000 in unpaid dues, interest and legal fees, according to Clark County records. A Notice of Default was filed on behalf of Mountain Trails Community Association after monthly dues started going unpaid in January 2025.

 

Bobby Samini, a lawyer for Mayweather, said that the issue was an accounting oversight and that the dues have since been paid, noting the boxer recently retained a new accounting team and a chief financial officer. He declined to comment further on behalf of Mayweather. Representatives for Mountain Trails Community Association didn't respond to requests for comment.

 

Many HOAs are under pressure to meet stricter safety standards enacted after the 2021 Surfside condo collapse in Florida, including bans on underfunding structural reserve accounts. Because many older communities delayed maintenance for decades to keep dues low, some boards had to issue large special assessments to cover the shortfall. Many HOAs have had to raise dues.

 

Marc Schneider, a New York real-estate lawyer representing community associations, recently worked with a Long Island HOA whose annual insurance premium jumped from $60,000 to $360,000.

 

When delinquencies and foreclosures force boards to cut back or delay upkeep, it ultimately hurts property values for the entire neighborhood, he said.

 

To manage cash flow, the board at Fairview Condo 1 in Middle Island has been cutting spending rather than tapping cash reserves or levying special assessments.

 

 The building has had to delay routine projects such as power-washing the buildings and planting new flowers.

 

Fronting legal fees is costly and the foreclosure process is time-consuming, said Amilowski, the condo association president. "We have to do what's best for the entire community," she said.” [1]

The Houthis, an Iranian-backed militia in Yemen, said Wednesday that they had struck a Saudi oil tanker in the northern Red Sea, and they threatened to intensify attacks there in an effort to close “all access routes” to Saudi oil shipments.

 

The Houthi military spokesman, Brig. Gen. Yahya Saree, said the group had fired ballistic missiles at a Saudi tanker called Wafa near the Saudi port city of Yanbu, though he did not say when the attack had occurred. The Saudi authorities did not immediately respond to a request for comment on the Houthis’ claim.

 

The Houthis declared a blockade of Saudi shipping last month. The territory they control in Yemen is near the Bab al-Mandab Strait, a narrow waterway that leads into the southern end of the Red Sea.

 

The group claimed on Wednesday to have attacked eight ships linked to Saudi Arabia since the blockade. The strikes have forced some shipping companies to reroute to the northern part of the Red Sea. The group’s latest threat suggested that it would pursue Saudi tankers there also, in waters heading toward the Suez Canal, another crucial artery for global trade. The global oil price, after two days of declines, jumped 1 percent on Wednesday, to about $80 a barrel.

 

The Houthis and Saudi Arabia are longtime adversaries. In 2015, Saudi Arabia assembled a military coalition that failed to oust the Houthis from power after the group seized the Yemeni capital, Sanaa, setting off a devastating civil war.

The Red Sea has taken on greater importance in recent months after fighting between the United States and Iran effectively closed the Strait of Hormuz, a vital corridor for oil and gas shipping in the Persian Gulf. That disruption led Saudi Arabia to reroute much of its oil through pipelines to port cities on the Red Sea, where the Houthis are now concentrating their attacks.

 

The Saudi-led coalition has for the most part not publicly confirmed or denied specific Houthi claims of attacks. Since the blockade was announced, the coalition has struck the Houthi-controlled port city of Hudaydah, saying it targeted “legitimate military targets” used to threaten commercial vessels.

 

That has done little to avert the Houthis’ attacks. On Tuesday, the group claimed to have struck an airport in Najran in southwestern Saudi Arabia, though the Saudi authorities did not comment and it remained unclear whether such an attack had taken place.

 

Later Tuesday, an Indian cargo ship sank in the Red Sea after being struck by a projectile, according to the Indian government. All 14 crew members were rescued. The Houthis did not claim the attack, though the internationally recognized government of Yemen blamed the Houthis.

 

The attacks and threats came as Washington and Tehran kept open the prospect of renewed diplomacy after a cease-fire that had effectively collapsed in recent weeks. President Trump told Fox News that the two sides had held “very good discussions,” though Iranian officials continued to play down expectations of an imminent breakthrough.” [1]

As Delfi already wrote, the State Border Guard Service (SBS) tried to hide this incident from the public.

 

Minister of the Interior Martynas Katelynas announced that he was also not properly informed about what happened, so he launched an internal investigation into the heads of the SBS.

 

On Wednesday, Delfi, citing sources, published a covered-up incident at the border, when a group of migrants attacked border guards. This happened on July 26 in the Lazdijai district, in the Kapčiamiestis barrier area, near the border with Belarus.

 

Concealed from the minister as well

 

Minister of the Interior Martynas Katelynas informed at a press conference on Wednesday that he also learned about the incident only today.

 

"I was formally informed about the incident earlier that the tunnel excavation was prevented, but I only learned about the essential details this afternoon.

 

From the news published on social networks, I understood that I was not provided with all the information about this incident at the border.

 

After returning from the Government meeting, I urgently called Rustam Lyubaev to provide details about this incident. The border guard commander admitted that he takes responsibility for the fact that the importance of this incident was not properly and fully assessed and the minister was not properly informed," said M. Katelynas.

 

According to him, after a conversation with the commander of the State Border Guard Service, he decided to launch an internal inspection in order to objectively assess the actions of the border management.

 

Prime Minister: this is unacceptable

 

The Prime Minister stated that on Wednesday, after the Government meeting, he was informed about this incident by the Minister of Internal Affairs Martynas Katelynas and instructed to clarify all the circumstances.

 

“Today, after the Government meeting, the Minister of Internal Affairs informed me about the incident. The incident that apparently occurred on July 26.

 

I instructed the Minister to clarify all the details very clearly,” the Prime Minister said.

 

According to him, the explanation of the situation should include answers not only to questions about the actions of the officers themselves, but also why information about the incident reached the public and the political leadership only after more than a week.

 

“The clarification related to the incident should include several questions: why today and not earlier, why we only learned about the incident that probably occurred on July 26 today.

 

I hope that the officers did their job, but I have questions about the non-disclosure of the information,” he said.

 

When asked by journalists whether the Minister of Internal Affairs also learned about the incident only on Wednesday, the Prime Minister replied that, in his understanding, that was the case.

 

“Yes, I understood that it was.”

 

When asked whether such a situation was acceptable, M. Sinkevičius did not hide his criticism.

 

“It is definitely unacceptable. I do not want to rush to conclusions, maybe there are some objective reasons why this was not done, maybe internal investigations were launched, I do not know. But at first glance, this situation does not seem appropriate,” the prime minister said.

 

Border guards attacked

 

As Delfi wrote, after recording the tunnel being dug, four border guards were waiting in ambush. As expected, the migrants digging the tunnel were discovered on Sunday evening.

 

Initially, several foreigners were detained and handcuffed. While the detention was taking place, about 20 newcomers attacked the border guards. The officers had no other choice, so they started to run. Service weapons were not used during the incident.

 

After that, the migrants ran back to Belarus, including the handcuffed people.

 

Lazdijai politician Vilma Danauskienė wrote about this hidden incident on Facebook.

 

“Maybe the General of the State Border Service would tell us how the leadership of the Varėna detachment and the Kapčiamiestis barrier did not appreciate the operational information received from foreign colleagues and sent our border guards (FOUR) against a group of more than TWENTY migrants armed with sticks and stones?

 

Or maybe Minister of the Interior Martynas Katelynas would be interested in knowing how the border guards who arrived while digging a tunnel (ah, the “engineers and doctors” were found in the midst of the work) illegally attacked and beat our officers?” – V. Danauskienė wrote on Facebook.

 

The politician claims in the post that the heads of the State Border Guard Service decided to hide this incident, and will try to quietly shift the blame for everything to ordinary officers.

 

She did not answer questions

 

The State Border Guard Service (SBS) announced about this tunnel on July 29. However, the attack on the officers was kept quiet.

 

The press release states that the officers used technical means to determine, based on ground vibrations, that an underground tunnel was likely being dug near the state border near the village of Pertaka (Lazdijai district).

 

According to the SBS, the tunnel was not finished digging, there was no exit opening beyond the patrol path, so illegal migrants did not have the opportunity to invade our country.

 

“After seeing the border guards who had arrived, about twenty foreigners – young men in civilian clothes – fled to the territory of Belarus,” the same report says.

 

“Delfi” contacted the State Border Service on Friday with an inquiry about the incident in which the officers were injured. The State Border Service representative Lina Laurinaitytė replied within a few hours that they did not have such data and asked to clarify where the information came from.

 

Immediately after receiving this response, “Delfi” asked whether an incident in which the officers lost their handcuffs had been recorded. The State Border Service delayed answering this question and provided a laconic comment only on Tuesday evening.

 

“On July 26, a dug tunnel was discovered near the state border sign No. 0028. It was closed. The officers were not injured,” the response was received with reference to a press release.

 

L. Laurinaitytė refused to answer questions about whether the migrants had entered Lithuanian territory and whether the handcuffs were lost during the incident, citing that a pre-trial investigation was underway.

 

The tunnel was dug on the bank of a stream, 9.5 meters from the physical barrier. The tunnel was supposed to go under the patrol path deeper into Lithuanian territory. Next to the tunnel, there were logs that were stretched, most likely intended for supports, excavated sand, and buckets inside.

 

Belarus and Lithuania are separated at this point by an unnamed stream, and the physical barrier, a metal fence and a concertina, is installed deeper into the territory of our country due to unstable soil.”

“Trečiadienį paskelbta informacija, kad liepos 26 dieną prie sienos su Baltarusija būrys migrantų užpuolė pasieniečius.

 

Kaip jau rašė „Delfi“, Valstybės sienos apsaugos tarnyba (VSAT) šį incidentą stengėsi nuslėpti nuo visuomenės.

 

Vidaus reikalų ministras Martynas Katelynas pranešė, kad jis taip pat nebuvo tinkamai informuotas apie tai, kas įvyko, todėl pradėjo tarnybinį patikrinimą dėl VSAT vadovų.

 

Trečiadienį „Delfi“, remdamasis šaltinių informacija, paviešino nuslėptą incidentą pasienyje, kai būrys migrantų užpuolė pasieniečius. Tai įvyko liepos 26 dieną Lazdijų rajone, Kapčiamiesčio užkardos teritorijoje, prie sienos su Baltarusija.

 

Nuslėpė ir nuo ministro

 

VRM ministras Martynas Katelynas trečiadienį per spaudos konferenciją informavo, kad jis apie įvykį taip pat sužinojo tik šiandien.

 

„Apie incidentą formaliai buvau anksčiau informuotas, kad buvo užkardytas tunelio kasimas, bet apie esmines detales sužinojau tik šiandien po pietų.

 

Iš socialinių tinklų, paskelbtų naujienų, supratau, kad man buvo pateikta ne visa informacija apie šį incidentą pasienyje.

 

Grįžęs iš Vyriausybės posėdžio skubiai iškviečiau Rustamą Liubajevą pateikti detales apie šį incidentą. Pasieniečių vadas pripažino, kad prisiima atsakomybę dėl to, kad šio incidento svarba nebuvo tinkamai ir pilnai įvertinta ir ministras nebuvo tinkamai informuotas“, – kalbėjo M. Katelynas.

 

Pasak jo, po pokalbio su VSAT vadu jis nusprendė pradėti tarnybinį patikrinimą tam, kad būtų objektyviai įvertinti pasienio vadovybės veiksmai.

 

Premjeras: tai nepriimtina

 

Ministras Pirmininkas teigė trečiadienį po Vyriausybės posėdžio apie šį įvykį buvęs informuotas vidaus reikalų ministro Martyno Katelyno ir pavedė išsiaiškinti visas aplinkybes.

 

„Šiandien po Vyriausybės posėdžio vidaus reikalų ministras mane informavo apie incidentą. Liepos 26 dieną, berods, įvykusį incidentą.

 

 Pavedžiau ministrui labai aiškiai išsiaiškinti visas detales“, – sakė premjeras.

 

Pasak jo, aiškinantis situaciją turėtų būti atsakyta ne tik į klausimus dėl pačių pareigūnų veiksmų, bet ir kodėl informacija apie incidentą visuomenę bei politinę vadovybę pasiekė tik po daugiau, nei savaitės.

 

„Su incidentu susijęs išsiaiškinimas turėtų apimti kelis klausimus: kodėl šiandien, o ne anksčiau, kodėl apie liepos 26-ąją tikėtinai vykusį incidentą mes sužinome tik šiandien.

 

Tikiuosi, kad pareigūnai atliko savo darbą, bet dėl informacijos nepaviešinimo man kyla klausimų“, – teigė jis.

 

Žurnalistams paklausus, ar vidaus reikalų ministras apie incidentą taip pat sužinojo tik trečiadienį, premjeras atsakė, jog, jo supratimu, taip ir buvo.

 

„Taip, supratau, kad taip.“

 

Paklaustas, ar tokia situacija yra priimtina, M. Sinkevičius neslėpė kritikos.

 

„Tikrai nepriimtina. Nenoriu skubėti su išvadomis, gal yra kažkokių objektyvių priežasčių, kodėl taip nebuvo daroma, gal buvo pradėti vidiniai tyrimai, nežinau. Bet iš pirmo žvilgsnio ta situacija neatrodo tinkama“, – sakė premjeras.

 

Užpulti pasieniečiai

 

Kaip rašė „Delfi“, užfiksavus kasamą tunelį, keturi pasieniečiai laukė pasaloje. Kaip ir buvo tikimasi, sekmadienio vakarą aptikti tunelį kasantys migrantai.

 

Iš pradžių keli užsieniečiai sulaikyti ir surakinti antrankiais. Kol vyko sulaikymas, maždaug 20 atvykėlių puolė pasieniečius. Pareigūnai neturėjo kitos išeities, todėl pradėjo bėgti. Tarnybiniai ginklai incidento metu nepanaudoti.

 

Po to migrantai spruko atgal į Baltarusiją, tarp jų ir antrankiais surakinti žmonės.

 

Apie šį nuslėptą incidentą feisbuke parašė Lazdijų politikė Vilma Danauskienė.

 

„Gal VSAT generolas papasakotų, kaip Varėnos rinktinės ir Kapčiamiesčio užkardos vadovybė neįvertino iš užsienio kolegų gautos operatyvinės informacijos ir išsiuntė mūsų pasieniečius (KETURIS) prieš daugiau nei DVIDEŠIMTIES lazdomis ir akmenimis ginkluotų migrantų grupę?

 

O gal VRM ministrui Martynas Katelynas būtų įdomu sužinoti, kaip atvykusius pasieniečius tunelį kasę (aha, rasta „inžinieriai ir gydytojai“ pačiame darbų įkarštyje) nelegalai puolė ir sumušė mūsų pareigūnus?“ – feisbuke rašė V. Danauskienė.

 

Politikė įraše tvirtina, kad VSAT vadovai nusprendė nuslėpti šį įvykį, o kaltę dėl visko bandys tyliai suversti paprastiems pareigūnams.

 

Į klausimus neatsakė

 

Apie šį tunelį Valstybės sienos apsaugos tarnyba (VSAT) paskelbė liepos 29 dieną. Tačiau apie pareigūnų užpuolimą nutylėta.

 

Pranešime spaudai rašyta, kad pareigūnai techninėmis priemonėmis pagal žemės paviršiaus virpesius nustatė, kad prie valstybės sienos ties Pertako kaimu (Lazdijų r.), tikėtina, kasamas požeminis tunelis.

 

Pasak VSAT, tunelis buvo nebaigtas kasti, išėjimo angos už patrulio tako nebuvo, tad per šią požeminę trasą neteisėti migrantai ar kiti asmenys įsibrauti į mūsų šalį neturėjo galimybės.

 

„Pamatę atvykusius pasieniečius, į Baltarusijos teritoriją pasišalino apie dvidešimt svetimšalių – jaunų civiliniais drabužiais vilkinčių vyrų“, – rašoma tame pačiame pranešime.

 

„Delfi“ dar penktadienį kreipėsi į VSAT su paklausimu apie incidentą, per kurį sužaloti pareigūnai. VSAT atstovė Lina Laurinaitytė per kelias valandas atsakė, kad jie tokių duomenų neturi ir prašė patikslinti, iš kur gauta informacija.

 

Iškart gavus tokį atsakymą „Delfi“ perklausė, ar užfiksuotas incidentas, per kurį pareigūnai prarado antrankius. Į šį klausimą VSAT delsė atsakyti ir lakonišką komentarą pateikė tik antradienio vakarą.

 

„Liepos 26 d. prie valstybės sienos ženklo Nr. 0028 buvo aptiktas iškastas tunelis. Jis buvo užverstas. Pareigūnai nenukentėjo“, – toks atsakymas gautas su nuoroda į pranešimą spaudai.

 

Į klausimus, ar migrantai buvo patekę į Lietuvos teritoriją ir ar per incidentą prarasti antrankiai, L. Laurinaitytė atsisakė atsakyti, motyvuodama, kad vyksta ikiteisminis tyrimas.

 

Tunelis buvo kasamas upelio krante, už 9,5 metro iki fizinio barjero, Tunelis turėjo eiti po patrulio taku gilyn į Lietuvos teritoriją. Šalia tunelio liko sutempti rąstai, greičiausiai skirti atramoms, iškastas smėlis, viduje – kibirai.

 

Baltarusiją ir Lietuvą šioje vietoje skiria bevardis upelis, o fizinis barjeras, metalinė tvora ir koncertina, dėl netvirto grunto yra įrengtas giliau į mūsų šalies teritoriją.”
