The Lithuanian court confiscated more than 0.5 million Eur from a convicted bankruptcy administrator

"On Monday, the Lithuanian Court of Appeal confiscated more than half a million - 560,000 Euros of cash from a convicted bankruptcy administrator.

    Raisa Trimailienė was convicted of promising the former director of the bankrupt company to end the bankruptcy proceedings in return for a fee of EUR 14,000 and accepting part of this bribe of EUR 10,000.

    Approximately € 560,000 in cash in various currencies was found during an investigation in the bankruptcy administrator's individual safe deposit box.

    The prosecutor who supported the state prosecution asked the court to apply extended confiscation of property and transfer more than EUR 560,000 held by R. Trimailienė for the benefit of the state. The court had previously ruled that there was insufficient evidence in the case that the money had been obtained from a criminal offense.

    However, the Court of Appeal takes the opposite view.

    "The panel of judges of the Court of Appeal of Lithuania concluded that the money found in the individual safe deposit box (the data in the case suggest that the individual safe deposit box was used to store money obtained from criminal offenses) was acquired by RT in the 5 years prior to the crime, these assets do not correspond to her legal income, exceed the amount of MGL 250, so it decided to apply extended confiscation of the assets and confiscate the said funds, ”the court informed BNS.

    The appeals of the convicted lawyer R. Trimailienė and her defense counsel were rejected.

    Following the verdict of the Court of Appeal, the sentence became final.

    R. Trimailiene was also fined almost 35,000 euros for bribery and illegal possession of a weapon.

    The court also banned her from working in insolvency proceedings for three years, confiscating an illegally held Italian revolver and two ammunition from R. Trimailienė.

    Ričardas Gailevičius, the prosecutor of the Kaunas Regional Prosecutor's Office, was asking for a five-year and seven-month prison sentence against R. Trimailienė, but the former bankruptcy administrator was released.

    R. Trimailienė was detained by officials in March 2018."
